Yeah. This is a setback to be sure. The whole Obamacare was dead and now the door is left open for states athat are pro-Obamacare to move forward with preparing to implement parts of it. The judge blinked. Hopefully he will close the door completely in seven days or shortly thereafter if the appeal is rejected.

No matter what Obamacare will never be enforced. It will be defunded and some states will continue to ignore it until the Supreme Court strikes it down. In a way this is good for convservatives because it will keep the issue alive well in to the next presidential election cycle and this is an extremely unpopular bill. It will only get more unpopular as its costs become mroe and more apparent.

Yeah it is good, but the President put the entitlements up front and delayed the ton of cost for the entitlements to later.

Yeah, anyone can get insurance, but if you have to cover a preexisting condition they probably have to charge 9k a month to cover it so it isn't welfare in some cases.

I agree and at least 5 of the Supremes often go by the Constitution and not French law, so this would be invalid regarding the forcing of people made to buy insurance or getting a $5,000 fine through the IRS.

The question I wonder is will the fact they forgot to make it severable really kill it all or will the Justices just kill it in part?

UNLESS obama seeks an appeal within 7 days, the judge will not issue a stay. Did you READ the opinion?

Did you see where he ridicules obama for his question of "clarification"?

Let's be clear - obama HAS to seek an appeal of this ruling, which he hasn't done of course, in order for a STAY to be issued.

Why is this so hard to understand?

Understand, obama DID NOT want to see an appeal so quickly, he wanted to slow walk it, drag it out for years, but then when the states said they would follow the judges VOIDING of the law, would not implement obamacare, that is when obama seeked "clarification" from the judge.

Well, he certainly got his derriere clarified by this judge.

In case you don't want to read the whole thread

The short version.

The Judge backed off his own ruling and agreed with the Obama Administration that this ruling can be stayed on appeal.

The Obama Admin won that small battle.

Why did he do that?

Because his ruling was on the merits weak, and when you have a weak argument you want to give the higher court all the time in the World to consider your weak argument rather than pisse them off, having to deal with the short term effects of stopping the legislation immediately.

Incredible. It would normally be stayed on appeal. Instead of appealing immediately, obama tried to ignore the ruling...but we weren't going to allow that.

One more time, the stay is GRANTED, as long as obama seeks a repeal within 7 days.

Which means it is on the FAST track and will be decided sooner rather than later.....somewhere around Nov 2012...which means the unpopular obamacare will STAY a focal point in the next election. Worked pretty good in the last, don't you think?
