Check this out though about bars ( in Michigan where I live ).

Smoking has been banned. Good old Jennifer Granholm. I will even accept and cringe at the same time for her "concern for our health". There were other motives as well.

But, bars across the state have lost business because of this. Some have closed. Smokers want to be able to smoke when they go to a bar.

Tough crap says Jennifer.

I think this whole thing is BS. If a 1yr old wouldn't make a face after drink'n a margarita that the parents wouldn't notice, then the parents were already drunk and the kid probably has had it before.

My kids get pi$$y over pepsi vs coke and they are teenagers.

Plus, who can't smell a margarita at the table?


What gave it away wasn't the breath test, it was the kids sig hang'n out of his mouth.

Another case of lazy people look'n for a free ride.

I guess it just depends on where you are.

I would only sue if some sort of damage was done to my child as a result of or because of consuming alcohol.

I have been to Applebees with my 2 year old. It is a family restaurant and kids are allowed there BTW. They get little kids cups with lids, you cannot see what is in them. I have never tasted any of my kids' drinks (I also have a 9 year old) unless I am thirsty and they get their drink first or they indicate that it tastes nasty. I have never seen a parent taste the drink of a toddler that was ordered from a restaurant as soon as it is brought. Those of you that do are rare. We go out a couple times a month as a family for dinner at sit down restuarants and I have never seen that occur. I have talked to my mommy friends about this situation as another recently happened at an Olive Garden as well. None of the moms I know do this either, taste the kids' drink when it comes. I will be tasting them for a while though now since this has been in the news.

this country is way too sue happy.

everybody wants to make an easy buck.

remember that heroic pilot that safely landed that plane in the hudson river and save all the passangers lives?
many of those people filed suit against the airline and were dismissive of the pilot.

it amazes me how evil most americans are.

I thought common sense was extinct after reading some of the obvious b.s. on this thread.
Folk testing the drink first like the kid is a king or has an assassin after them.
Folk not smelling what it was even with a closed cap on it!!..I guess some folk are half blood hound now!!

I have three girls and we have attended Applebee's at least twice a month since the birth of my first eleven years ago.

My wife and I have never checked their cup looking for anything amiss, we may drink some, being greedy, before they get it or we used to dilute it with water, but we never checked for contaminants.

Our children are old enough now to tell us if something is wrong, but I would start checking if I had younger children.

To suggest the parents are negligent, looking for money, were lazy, etc is just silly non-sense.

I'm thinking that a lot of the folks in the "negligent parent" crowd don't have toddlers at home. I have a 2 y/o and when we frequent restaurants, I do not taste her drink first. The kid's cups usually have a lid and is sipped through a straw...no odor to detect.

I would be LIVID if a server gave my child alcohol. First off, it's a kid's cup...not to be confused with an adult glass. How exactly do you "accidentally" pour alcohol in a kid's cup? Whether it was done purposely or from neglect, this was a MAJOR screw-up. Those making light of this should be ashamed...thankfully nothing happened to this child, but if adults can die from alcohol poisoning, the risk to 1 year old has to be 1000 times greater.

Did they really pour alcohol in a tippy cup ??????

Meanwhile, most 1 year old kids crawl around the floor eating anything they can get their hands on... bugs, spiders, week old french fries, dirty sox, etc, etc.

And guess what... they live to tell about it.
