I don't know if I would "sue", but... I would call the cops and file a formal complaint. I might contact a lawyer? not sure? But discussing my options with a Lawyer doesn't mean I'm ready to sue. I certainly would be very very upset about this.
No I wouldn't sue them. I think the family is just looking to make a quick buck, like the person who sued McD's because they spilled hot coffee on their lap and there was no warning on the cup

I wouldn't compare an adult drinking hot coffee to an infant getting served a margarita. By the way, the McD's customer originally requested McD's to pay for her medical bills, nothing more. McD's refused and she decided to sue.
I'm confused by this story. Something isn't adding up. Margarita mix clearly looks different from apple juice. Why didn't the parents notice?
Why didn't the waiter notice? Maybe they did notice and assumed it was punch and didn't care. Few parents would raise a hissy fit over mixed up juice drinks.
That as well, though presumably the waiter isn't paying as much attention to what a child drinks as his parents are. I'm not trying to place the blame on the parents at all, please don't get me wrong! Something just seems strange.
The only thing I can think is that maybe it was served in one of those special children's cups that some restaurants have, but then it should have been even more noticeable to whoever poured the drink.
