Affirmative action is in effect in every aspect of your life. You know someone, who knows someone, you look like someone, you remind someone of somebody they know or like, etc. You don't get in anywhere on hard work alone. And if you think you do, I got a bridge in Brooklyn to sell ya.
So in your example the DOJ sued a company that apparently did not practice AA,.... So the question again is what jobs or schools still use the practice of AA? I often see these questions posed every other week here on CD, but no one has been able to provide any example of companies that use AA when hiring or admitting students.
Michigan passed a ballot initiative a few years back to end affirmative action in the state. Multiple groups have fought to overturn the voters' choice for years now and federal judges have done just that. The University of Michigan used a point system for admissions and gave more points to Blacks and Hispanics. The law banned this practice. Now it's back.
Here's another one where the Department of Justice forced Dayton to lower their scoring standards for their police department because not enough minorities were passing:
As the article states, this type of thing is going on around the country. The Department of Justice has restarted their Civil Rights division and they're aggressively forcing cities across the country to practice affirmative action.

You do realize that the college point systems are used not only with minorities but also with so called legacy sytems. Students who's parents work at the colleges where their parents work get preferential treatment. As far as the civil servent tests, i'm on the fence with that isse. Part of me feel that the applicant need to get their study on, but then the educational system in the U.S is no where near a balanced one.
How can you hire the best person for the job without exercising prejudice?
That is not being predjudiced. It is being smart. What business owner is going to hire someone less competent when someone more competent has applied for the same job?

Exactly!
In the Silicon Valley most of the new hires are foreign born. A/A at its finest, but not everyone would agree.

Yeah, I know that points are given for other reasons besides race. The laws that were passed in California and Michigan banned using race as a factor. For the University of Michigan, they actually used a messed up racial point system where they gave no added points to Whites, gave some points to Hispanics, gave more points to Blacks, but actually took away points from Asians. After racial consideration was banned, they got around it by giving points for "life essays" and they tried to determine race based on the essay.
And with regards to testing: if you set a low bar for certain groups and those groups know that they don't have to perform at par with others, then what kind of results do you expect?

I agree. We should move towards a meritocracy where hiring, promotions and college acceptance are based on aptitude and qualifications. Race or gender shouldn't be a consideration at all.
Right off the bat, you show that you have no understanding of affirmative action.
It is not "special treatment" - it is selecting the minority when all other things are equal.
Period.
You can't address an issue unless you can define it with integrity.
