If you are in a war, you do not stop to arrest and try ever single opponent on the battlefield. It is not feasible, and it has never been done - no even in the US.

Letting presidents decide who they can kill even american citizens is potentially a disaster to liberty in the future. After all the VP Biden called tea party people terrorists maybe they will get kiled next.
If the President can kill an American citizen, on his own, without Judicial or even Congressional oversight........what can't he do?

Pedilla was arrested on May 8, 2002 by the FBI and held, without charge, as a material witness. On June 9, 2002 Mr. Padilla was declared an enemy combatant and transfered to Guantanamo Bay as per ex parte Quirin.
Padilla would not be charged with any crime until November of 2005

There are lots of reasons this country is in decline.....usually I am in agreement with you Padcrasher, but I'm not on your side on this issue. Glad Awlaki is a dead man. The world is better off without him.
Because he was born IN the United States, he is a citizen until he goes through a formal process of declaring renunciation of his citizenship, under oath, before a consular official.. That is the ONLY way he can lose his US citizenship.
His citizenship isn't germane to the issue, see ex parte Quirin.
