Would the people walking down the street be charged too if they happen to look in the direction of that open window? What is happening with this country? We are becoming a complete police state where you can get arrested for looking out your window? Maybe her parents should be arrested for letting her change with the windows open?

Even if this guy had been flogging his dolphin, so long as you couldn't see him doing that from outside his window, is perfectly legal unless you live in a police state! What is wrong with this country?

Oops, my mistake! I must have been slightly distracted when I read the "without" and read it as "with". My apologies to those I "all caps" screamed. Was doing housework while reading and responding. So sorry. No, he shouldn't have been arrested.

What I would like to know is how they knew he was watching unless the neighbors were also looking into HIS house.

The real problem here are ADAs and DAs. A DA position now has become a stepping stone to a career in politics, which attracts people with presonality disorders who will do anything to get what they want. This is a reflection on our society, and the saddest part is that we keep on electing mentally ill people to political office, so we reward their behavior. These DA's are trying to make names for themselves at the expense of people's simple right to look out the window.

I think as long as it wasn't prolonged and he didn't shift his position to get a better look and so on, it's not grounds for being arrested.

Here's a hypothetical. Say if the neighbor had a giant TV and was watching child porn, and the neighbor looked out his window and saw it. Didn't report it, and another neighbor calls the cops on both. Is the person who saw it from his window guilty of any crime? Surely the one with the child porn on the TV would be.. But the guy looking out the window?
