the question about mccain's eligibility had to do with the fact that in the year mccain was born canal zone babies were specifically considered by congress to be "US nationals" and not "US citizens". a year later congress reversed this decision and made it retroactive.

Actually... it wasn't Democrats who challenged McCain. He was sued in New Hampshire by conservative Republican Fred Hollander, and in California by Markham Robinson, chairman of the right wing American Independent Party.

Again, the Ankeny court never even raised the issue that there was no proof before the court that Obama was "born within the borders of the United States."
They didn't have to. Ankeny never argued that Obama was born outside the United States.
That decision (and the appeal) never addressed the fact that Gray was incorrect (as is HistorianDude - how ironic ) in assuming British law regarding natural born subjects applied to U.S. citizens.
They didn't address it because they agreed that Gray was correct.
