I'm sure there are false accusations. I'm not sure they are particularly common.

Ok, tell me, if someone puts a bullet in the side of your head and blows half your head off, when did you become a victim? If they never find the shooter, what does that make?

Take a moment and think about it, the crime creates the victim, not some legal proceeding.
