Ok, now it gets interesting. Have we had an earlier "dual citizen" President? If not then what the hell does that have to do with it? And I'd like to see some legal verification for this both parents citizens thing the cons have grasped onto
He lost his British citizenship on the day Kenya became independent. The Kenya Independence Act of 1963 (a British law, not a Kenyan one) withdrew citizenship of the United Kingdom and Colonies from people who became citizens of the newly independent Kenya. This included both Obama and his father.
Then its a very good thing that you can be born a dual citizen and a natural born US citizen at the same time.
Another lie. You need to take off the tin foil hat and learn historical facts. You can't be born a dual citizen and a natural born Citizen. Remember: A statutory citizen (bestowed by man's pen) like Obama can never be a "natural born" citizen (bestowed by God/nature). Now lets look at the facts that our anti-Constitutional friend Historianliar doesn't want you to know.
From Obama's website Fight The Smears proving his birth was governed by a foreign sovereinty, the nation we fought to gain our independence:
"When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom's dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.'s children:
That last sentence above confirms Obama is a dual citizen.
British Nationality Act of 1948 (Part II, Section 5): Subject to the provisions of this section, a person born after the commencement of this Act shall be a citizen of the United Kingdom and Colonies by descent if his father is a citizen of the United Kingdom and Colonies at the time of the birth."
So Obama has British Citizenship at the time of birth, that is a given. Did he gain citizenship to Kenya? Yes - via Chapter VI, Section 87(2):
"(2) Every person who, having been born outside Kenya, is on
11th December, 1963 a citizen of the United Kingdom and Colonies or
a British protected person shall, if his father becomes, or would but for
his death have become, a citizen of Kenya by virtue of subsection (1),
become a citizen of Kenya on 12th December, 1963."
But did becoming a Kenyan Citizen terminate British Citizenship? We look into the Kenyan Constitution and find - NO, it did not. See Chapter VI, Section 95(1):
"95. (1) Every person who, under this Constitution or an Act of
Parliament, is a citizen of Kenya or who, under any law for the time
being in force in a country to which this section applies, is a citizen
of that country shall, by virtue of that citizenship, have the status of a
Commonwealth citizen."
Obama has never renounced his British Citizenship gained at birth. He never automatically' lost it, even when Kenya became independent. In our country Article 2 Section 1 to be president says you have to be a Natural Born Citizen. Being born a dual citizen at birth is not natural and it doesn't qualify him eligible for the office.
TODAY, we apparently have a British Citizen in the office of the President in the U.S..
No idiot, he might have lost his Kenyan citizenship but he never lost his British Citizenship. You can't be born a dual citizen and then turn into a natural born Citizen later in life. Jeez. You need to read the British Act of 1948 more. The fact that Obama still has British citizenship is further supported by the following:
“Under United Kingdom law as it has been since the British Nationality Act, 1948, the acquisition of another nationality by a citizen of the United Kingdom and Colonies, of whatever age, makes no difference whatever to his status as a citizen of the United Kingdom and Colonies, and, therefore, he remains a British subject.
Moreover, it is not possible, under United Kingdom law, for the nationality of a child who is a citizen of the United Kingdom and Colonies to be changed by the decision of his parents. Only the child, when he reaches the age of 21, can renounce his citizenship of the United Kingdom and Colonies if he is then in possession of another nationality, but during the child’s minority neither the child nor his parents can do anything to forfeit his birthright of British nationality.” Children Bill [Lords], HC Deb 27 June 1958 vol 590 cc743-830.
“It is now the law that all persons born in the United Kingdom or its Colonies, or in countries which were Colonies at the time when they were born, have British nationality whether they are legitimate or illegitimate. . . . Also, it is part of our law that children of a British male born abroad can have British nationality.” British Nationality, HC Deb 16 July 1963 vol 681 cc341-3
What does this mean? Under the Kenyan Constitution, Obama is presumably no longer a Kenyan citizen because he did not renounce at age 21 his British citizenship and his U.S. citizenship (assuming he was born in the U.S.). Obama is still however a British citizen not only under English common law (in the words of Coke and Blackstone, a natural-born subject of the United Kingdom) but also under British citizenship statutes. Neither Kenya’s 1963 constitution nor any statute erased the consequences of the British common law and nationality statutes that were in effect at the time of Obama’s and his father’s birth. Obama’s continuing British citizenship is further confirmed by English law which provides that persons born in countries which were Colonies at the time when they were born are still British citizens. Hence, Obama continues to be a British citizen despite Kenya’s independence and new constitution.
Incorrect because upon becoming a citizen of kenya his father would now no longer be a citizen of the united kingdom.A little more than a 1/3 of the way down is explains that in order to become a citizen of kenya one needed to forfeit their rights as citizens of the empire. A person who, upon the attainment of the age of twenty-one years, is a citizen of Kenya and also a citizen of some country other than Kenya shall, subject to subsection (7), cease to be a citizen of Kenya upon the specified date unless he has renounced his citizenship of that other country, taken the oath of allegiance and, in the case of a person who was born outside Kenya. made and registered such declaration of his intentions concerning residence as may be prescribed by or under an Act of Parliament.
Obama, even if he had been a dual citizen IS not A Dual Citizen because he did not take a oath of allegience to Kenya or renounce his citizenship to the USA or register a declaration of his intentions concerning residence in Kenya as prescribed.
