In this case, that rule would apply if there was an arrest and a trial. No arrest, no trial so that is why Zimmerman is being tried by the public and at the same time being protected by the Florida police. Not exactly due process of law is it?
Whether pot is "the least harmful" or not is 100% irrelevant. The issue is the narrative surrounding Trayvon Martion in that he was this baby-faced, innocent, black kid mauled down by a overzealous racist.
Innocent children don't have disciplinary actions over drugs.
Attempts to try to circumvent the narrative to conclude marijuana possession is of no relevance to the notion that he is an innocent kid is disgusting.

And even if he had an ounce back at the house, what bearing does this have on Zimmerman trailing him and then confronting an unarmed kid with a weapon? Are you saying this makes it ok?

No one has said that Trayvon is innocent, in general. I'm sure we all have done "guilty" things in our past (and thank goodness for those fun times!). The focus instead is that during the time that led up to Zimmerman's approach, Trayvon had not committed any crime. Therefore, he was innocent. Get it?
So have I. But Trayvon wasn't high, so your point is moot.
