The problem for the liberals is that Thomas's wife (and Thomas himself) doesn't gain or lose anything either way the case goes. It's not like she's a major investor in a company that stands to gain money if the law is overturned. She was paid by groups opposed to the bill, but it passed anyway. So her part was over and done with once the vote was held - she's not going to get more money if the case goes one way or another now. It's no different than Sotomayor. She's ruling on Obama's signature legislation and she's an Obama appointee. How likely is it that he appointed her without confirming beforehand that she supported his signature legislation? But while she may have been appointed by Obama in the past, she's not beholden to him now. So nobody's asking her to recuse herself.

On the other hand, Kagan is in the position of judging a case she had a direct hand in crafting. Judges don't decide their own cases. That's actual, blatant conflict of interest in the here and now.
It's absurd to compare the two anyway. Thomas' wife's activities in her private life are not a reflection on Thomas.

Kagan on the other hand is sort of like the former CFO of Walmart, who is now sitting on the court to decide on law that involves things she was participating in, or implementing, while working for Walmart.

Kagan being a lefty probably thinks our constitution is outdated anyway so why follow it. Just ask Ginsberg as she thinks the same.

This is comparing apples to broccoli.

I know republican friends who have a wife that is a democrat, and still others where one spouse may work in a profession that the spouse has no training or interest in. A person's spouse can have differing views from them, and they can have different interests and hobbies from one another.

Kagan was Obama's Solicitor General, not her spouse, or her sister. Kagan was in the loop when ObamaCare's defense was being planned, not one of her friends or relatives.

This is such a no-brainer!!
Flip the parties and the faces. If this was a GOP administration, can you imagine the protests???? Can you imagine how the media would spin this??

I see nothing to justify recusing himself. He wasn't involved in any of those companies/orgs.

Was he charged with any crime in the disclosure form incident?

People revise all the time. Look at Geitner.

As an example, Bill Clinton's wife was a lawyer in the same state he was Governor. Should he have recused himself from all legal matters in that state that the law firm was involved in?

I cannot believe she does not remove herself from this case.

Typical left winger never doing the moral or right thing to do.


She was one who helped draft some of this and if this goes down it will show us all how "bought" or "stupid" she really was.

And to think Obama was an attorney, no wonder he failed as an attorney and lost his law license.

What are you kidding "HEADLINE NEWS" MAGAZINE COVERS, NEWSPAPER ARTICLES, and you all know it.
News commentators would have a field day with this, but as usual there is always bias towards the Dems, and that is true.
If this were a GOP administration, the spin would be out of control.
