But it lays the legal precedent for the court to find that it is. And I predict they will.
Too much stock is placed in "legal precedents". The Constitution is what it is - 5 opinions of out of 9 doesn't make the document invalid.

You have a sick and twisted mind.

I guess that makes two things we agree on. I am in favor of the death penalty, and I think the biggest problem with it is that it's not used enough. The default penalty for murder ought be death, and the only way out of it a jury finding that just enough doubt about guilt exists to take it off the table.

How, then, would you suggest we resolve constitutional disputes? "It is what it is" isn't good enough unless everyone agrees, which clearly is not the case.

You just stated that you support the death penalty - we are not in agreement on that issue.

No, we are not. We are in agreement on marijuana, however.

The death penalty and abortion have nothing to do with one another.

How does your position as quoted above in any way equate to my absolute opposition to the death penalty?

You misunderstood me.

When I said we were in agreement, I was referring to opposing marijuana prohibition. We disagree on the death penalty.

You said that we were in agreement with two issues. Forgive me for taking you at your word.

We are.

Age of consent issues and marijuana. Likely others, as well, especially as it relates to financial issues.
