I have no problem with this couple looking into suing this girl especially if she knew he was on the road driving during the time she was texting him. She seemed to know his work schedule.
I get tired of seeing people texting while they're in the middle of traffic.
Simple solution ..... you receive a text in the car then don't look at it and don't respond to it until you are no longer driving. Just because someone sends me a text does not mean I have to read it. Personal responsibility.
But texting or using a cell phone in a car is more controllable than dealing with a distracting child in a car. So a crash caused by a distracting kid is less likely to bring a lawsuit.
Weak. We are not talking about the actions of the driver but if the girl on the receiving/sending end of the texting is liable for his actions, his bad choices, his irresponsibility in texting and driving.
The driver did not need to respond immediately did he?
Bingo. Otherwise what happens if you dial a wrong number and it's a car driver who then crashes?
Otherwise you'd see a raft of lawsuits against radio stations for distracting drivers who call in to try to win tickets, lawsuits against pretty girls walking along the road because it distracted the driver, lawsuits against people with cool classic cars etc etc etc.
The cigarette manufacture suits had to do with the intentional misrepresentation of the addictive nature of the product being sold to the American people, not on a case by case suit of families who have lost loved ones to lung cancer.

and lung cancer has zero to do with smoking...kids who have never ever been near tobacco have lung cancer..people who have smoked for 70 years and still no lung cancer
my statment was clear to Greg, who said thye shouldnt be able to sue a manufacturor...my stamnet was clear if some alleged 'victim' can sue a cigarette company, or a weapons company....then they should be able to sue the app company.....didnt say I agreed or disagreed...was simple stating the LOGIC
life was so simple before cellphones...you either got ahold of me at home or the office..and when I put up the sign "gone fishing" I was out of reach
also..texting is limiting the ability of actual conversation of listened and spoken word
