If the question of whether the ACA penalty was a tax was the issue before the court that question would have gone down one to eight. Why do you on the right think a one to eight vote on what the penalty is called is a winner?

The Supreme Court called it a tax and the WH agreed with it. That was the only way it could be upheld.
Why are the left trying to forget that part ?

Not a tax? Not Constitutional.

If you still don't want to call it a tax, fine with me. Shall I send you a form letter to send to your representatives demanding that the law be repealed?

I'm pretty sure nobody on the right thinks the SCOTUS decision was a winner.

No matter how a handful of pundits may try to spin it, this is the biggest slap to freedom I've ever seen.

No, the supreme court did NOT say it was a tax, one justice called it a tax. You do understated what a majority opinion is, right? One justice ruling one way does not make his OPINION law.

It was called a penalty in Mass when Romney pushed it.

Without Roberts calling it a TAX, it would have been ruled unconstitutional. Take your pick, but you can't have it both ways.

BTW, why did the gov't legal team argue it as a tax then if it's not really a tax?

Because Obama said there would be no taxes. Then he also said this penalty wasn't a tax.
So, even though the Supreme Court upheld this because it is a tax, the left have to convince the people now that it really isn't a tax; they only "said" it was a tax to keep it in place.
