I think in this case it was justified. I read about this yesterday and that judge is pretty biased based on past speeches.
And several Republican judges already removed themselves from this mess with no comment as to why.
FWIW I think they should get someone from the Fed to come in and do this appeal.
DeLay is old school crony politics and I think they need folks from outside of Texas hearing this appeal.
