I think in this case it was justified. I read about this yesterday and that judge is pretty biased based on past speeches.

And several Republican judges already removed themselves from this mess with no comment as to why.

FWIW I think they should get someone from the Fed to come in and do this appeal.

DeLay is old school crony politics and I think they need folks from outside of Texas hearing this appeal.

From your link..this coming from a judge no less. You don't even need to try to convice anyone that she's biased:

She also said the GOP had "filled the courts, our appellate courts, with extremists, with people that are controlled by special interests, big insurance companies and big corporations."
She said the only activist judges in Texas are "those conservative right-wing zealots that control our courts today, and they're all Republicans."
