This incident is yet another example of the government completely disregarding and violating a citizen’s constitutional rights.
the one that is crazy is those who post summaries as links to a known Conspiracy website run by nut jobs.
Infowars is the equivalent of the National Enquirer and the The Globe. all they are good for is to be used as litter at the bottom of a cat litter box or shredded to use a packing material.
Those are words and nothing more, he took no action.Should we have pre-crime laws as in Minority Report?
He took no action, and he was not arrested. No similarity with Minority Report.
He talked about cutting off heads and leading a violent revolution. He mentioned both specific people and general classes of people. People who could see his FB page reported his posts to the authorities (there was no governmental monitoring involved). The authorities (FBI, local police) reviewed the posts and agreed there was a potential threat. They picked him up and placed him on a temporary psych hold for evaluation. No "big brother" here.
My buddy's uncle is missing somewhere on the streets of California with schizophrenia....family hasn't seen him in 2 years, he may be dead by now.
But hey, clap yourselves on the back that this guy was REALLY put in a padded cell because of his beliefs about 9-11. (Yet we have guys doing 9-11 conspiracy book tours...but hey, let's ignore the fact that the tends of thousands making similar claims aren't in a padded cell. )
It won't be you that have to care for him at home when he becomes violent. You won't have to try to find him on the street to get him warm clothes for the winter....or identify his body.
Some pretty sick individuals around here making politics out of the mental collapse of one of our veterans and the sad reality his family will have to face in trying to get him the help he needs.
The judge dismissed the case on the grounds that the petition "is so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy."
What is a "factual allegation?" Does not a Facebook post about planning to chop off people's heads constitute a "factual allegation?" Granted, citing lyrics from a song, or believing in conspiracy theories does not constitute a threat. However, combined with his other rhetoric about a violent revolution and the violence he intends to commit against others, I do not consider a three day psychiatric evaluation to be out of order.
Considering that he was also a Marine, and quite capable of carrying out his threats, it gives his violent rhetoric more credibility. I was also a Marine, a Combat Engineer. If I started making Facebook posts about blowing things up I would most certainly expect the FBI to show up at my door eventually. The more capable one is in carrying out violence, the more serious they should be taken when making threats of violence.
