Why not do both - judical review of the FEMA law and an amendment to the constitution allowing for FEMA?

Contradictory? Not at all. I wouldn't mind FEMA so much if it were implemented in a constitutional manner and managed properly.

Besides - we need an amendment passed so an entire generation doesn't go by without observing the process.

Quick - who can describe or state the 27th Amendment (hint - it was ratified in 1992)?

Now we can add Flood Victims to the list of people the righties don`t like. Gays,minorities,teachers,low wage workers,pregnant teens,climatologists,etc. Now it`s victims of natural disasters. Sad.

Federal emergency management is not a constitutional federal power.
It's been around for 34 years. The U.S. had had a long, long history of providing financial relief to states before it became FEMA.

That doesn't negate the fact that it violates the 10th Amendment.
