There's lots of things in the Constitution that gets the same treatment as well, especially the general welfare clause. Today the US and SCOTUS interpret the General Welfare Clause in the same way that Alexander Hamilton did, that the US collect taxes and spend the money on support programs that include, but are not limited to, agricultural production and education. So, the US providing for social welfare programs was not something that came into the discussion when FDR was elected

It's quite often Tom,Dick and Harry who have to make enough of a fuss to have the SCOTUS change/reverse their opinion and/or to come up with an opinion in the first place.

Yeah, we get it, you think that everyone who owns a firearm and disagrees with Feinstein's Folly just has to be a right-wing tea partier. Hate to be the bearer of bad tidings for you, but you're way off the mark. Personally, I despise the Tea Party and I'm a social liberal. All you have to do is check my post history to figure that out.
