Let's take this out of the usual anti-government nut realm. Or, to put it another way, let's assume what these guys assume: that the only obligations anyone has are obligations they have freely agreed to.

In this case, the guy freely agreed to all the contractual obligations of the mortgage, including its enforcement mechanism. Now he's just trying to avoid the consequences of his failure to carry out his obligations.
