From the bill:

Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime.
Strictly as written.....that would mean the woman who aborted because of rape could be prosecuted for tampering with evidence.

It does not even address if or when evidence is taken.

Now, was that an oversight or written that way on purpose?

Considering the anti-choice views of the author, you have to wonder.

Brown changes abortion bill after national outcry

"After a national outcry that forced her to take her contact information off the New Mexico legislature’s website, Rep. Cathrynn Brown, R-Carlsbad, has changed her bill relating to abortion.

The original language in the bill appeared to make it so women having an abortion of a pregnancy made through rape or incest could be charged with a felony charge of witness tampering. The new language would specifically exempt the woman who was having the abortion.

After Huffington Post reported on the bill, other national news organizations wrote about the bill. Even Comedy Central stepped in. It was an example of how fast in the age of the internet one small bill with little to no chance of even passing a committee could become a national story.

The bill had nine Republican co-sponsors."

BTW, fortunately Democrats hold the majority of seats in both chambers of New Mexico’s state legislature, so the bill was not likely to pass. Although as Salon wrote, "if you’re looking for proof of the callousness of the antiabortion movement and the extreme lengths to which they’ll go, you can at least give credit to Brown for providing the one thing she seems to care so very much about.... Evidence."

No, this is proof of the lengths to which Rep Brown will go. She is not "the antiabortion movement".

But then taking the words/actions of some extremist and generalizing them as representative of an entire movement is typical for many liberals.
