This should get very interesting. Judge O'Leary is one tough lady to do this patriotic deed. The case at hand was filed in July 2012. It involves evidence of one and a half million invalid voter registrations in the state of California. Additionally appeal involves lack of legitimacy of Barack Obama to the U.S. Presidency due to his use of forged IDs, stolen CT Social Security number, last name not legally his and fraudulent claim to be a U.S. citizen. Evidence in the case involves a certified copy of the passport records of Obama’s mother, S. Ann Dunham, which shows her son’s legal last name to be Soebarkah, not Obama, it involves Obama’s school records from Indonesia showing his citizenship to be Indonesian, sworn affidavits of top law enforcement experts and investigators showing Obama’s birth certificate and Selective Service certificate to be forged and Social Security number used by Barack Obama in his 2009 tax returns and posted on WhiteHouse.gov to be fraudulently used and failing both E-Verify and SSNVS.

1. Sanctions were imposed on Orly Taitz after the trial court found that her "birther" lawsuit was frivolous.
2. She tried to appeal the sanctions order. The appeal was disallowed because she failed to comply with the appellate rules.
3. She was granted leave to amend her appeal, and finally figured out how to do it properly. Judge O'Leary entered an order allowing the appeal to proceed.
4. The appeal will not address any birther issues, only sanctions against Taitz.
5. Orly Taitz is one of the stupidest lawyers in America, which is saying something.
6. The only thing interesting will be how much money the appellate court will force Taitz to pay in sanctions.

There is no person with standing to challenge President Obama's eligibility. Under the Constitution, a citizen does not have the right to vote for President, but for electors for the office of President of the United States. As stated by the Supreme Court: "The individual citizen has no federal constitutional right to vote for electors for the President of the United States unless and until the state legislature chooses a statewide election as the means to implement its power to appoint members of the Electoral College." Bush v. Gore, 531 U.S. 98 (2000), citing U.S. Const., Art. II, §1.
The Constitution does not define the term "natural born citizen"; rather the right of citizenship - as are all rights - are defined by law. In the United States, the right of national citizenship is defined by federal law; which legislative authority, under the Constitution, resides in Congress. In the 1950's, the Congress enacted 8 U.S.C. §1401, et seq. defining nationals and citizens of the United States at birth. These provisions, some of which apply retroactively, govern a person’s status as a natural born citizen; which federal statutes supercede prior case law (including decisions of the Supreme Court) on the subject of citizenship to the extent inconsistent with the Congressional legislation. Under this law, both Barack Obama and John McCain were eligible in the election of 2008 to be President of the United States. NB: Prior to the enactment of § 1403(b) of title 8 of the United State Code in 1952, Senator McCain would not have been deemed a "natural born citizen" eligible to be President. See Hollander v. McCain, 566 F.Supp.2d 63 (2008).
However, you don't ever get to the legal issue of eligibility because the courts do not have subject matter jurisdiction for lack of standing. As stated in Hollander v. McCain: "What is settled, however, is that an individual voter like Hollander lacks standing to raise that challenge in the federal courts. See Dugan & Collins, supra, at 115 (recognizing debates over meaning of Art. II, § 1, cl. 4, but concluding that voters lack standing to raise that issue judicially). Indeed, "[t]he purest reason to deny standing is that the plaintiff is not able to show an injury to the voter interest, however much the plaintiff may feel offended by the challenged practice." 13 Charles Alan Wright, Arthur R. Miller & Edward H. Cooper, Federal Practice & Procedure § 3531.4 (2d ed. 1984 & 2007 supp.) (footnote omitted). Because Hollander can show no such injury, this court lacks jurisdiction over his attempt to resolve the question of McCain's eligibility under Art. II, § 1, cl. 4. Whatever the contours of that constitutional provision, Article III has been definitively read by the courts to confer no jurisdiction over this kind of action." Id., 566 F.Supp.2d 63, 71 (2008). For this reason, the actions challenging President Obama's eligibility have been dismissed, and the appeals denied.
So when Obama leaves the White House without incident in January 2017, are all you birthers going to kill yourselves or leave the country?

I know you posted this tongue-in-cheek, but you're not far off. A birther bill in Arizona proposed exactly that. In 2011 the Arizona state Senate passed a bill that would accept a circumcision certificate in lieu of a long form birth certificate. Yeah, birthers really do want to see the president's junk. And yes, they truly are that idiotic.
The thing with birthers is, just when you think they've gotten as stupid as is humanly possible, they show you that there is a whole new level of stupid you never imagined.
many of the birther's have clung to the belief that there is some kind of "null and void" clause in the US constitution ( even tho the de facto officer doctrine directly contradicts that ). it's their fantasy belief that once "the truth" as they see it comes out every decision of obama's will be reversed no matter when this "truth" is revealed.
i expect the birthers, on a highly reduced scale, to be with us for at least a generation after obama leaves office.
