that's because the only thing in the constitution about sodomy laws is the 10th amendment (giving each state the power to do what ever it want including the death penalty), except in the fertile imagination of idiots like Ruth Bader Ginzburg.

I believe that every single state had anti sodomy laws when the bill of rights was ratified.
