And the State Dept, who has to approve these things, knows nothing about it.

More than likely they traveled through the Bahamas, Mexico or Canada, as do many Americans, the State Dept wouldn't know. No paperwork/license necessary and Cuba doesn't stamp American passports. If that is how the entered Cuba they may have thought it wouldn't be a problem, but they should have tried to avoid any publicity.
Not only that, there are probably more than a few Farm Belt politicians (many if not most of them Republicans) who would love to sell some corn and wheat to Cuba.
But I'll bet the folks who are trying to publicize that knows all this, and are just trying to make some noise to see if it eventually sticks.
