They didn't. Evidently they could hear the conversation through the door at the hall and they taped it there. The hallways are public areas.

Ok--this makes things clearer. The taping took place from a hallway outside of the McConnell campaign office, so he wasn't using his federal office for campaign activities--that hasn't been explained before. During the conversation, it refers to legislative aides doing opposition research on Ashley Judd. The campaign needs to make sure that they have clearly documented records of federal employees doing that work OFF TIME, and away from the federal building, using no federal resources (even the phone) or there's a big problem. The conversation is really tacky, but it's not illegal to call someone crazy in a meeting. The courts have also ruled that if you talk loudly enough to be heard through a wall, there's no expectation of privacy. It never occurred to me that you would have a loud conversation on a subject like that during the open house for your campaign office--who would do that?

Like I said, this will be interesting.

I think one was holding the elevator door while the other was recording hallway noise ... I fail to see why that "bugs" some people.

They were in the office building and the noise from the conversation was loud enough to hear in the hallway. I'm not saying it's not tacky, but it doesn't sound like it was illegal. Like I said--the other factor is hearing a conversation that implies that possible campaign ethics violations took place. It's an interesting situation.

The tape was taken in the hallway by Progrss Kentucky, probably through a vent in the door or underneath the gap at the bottom. Regardless, there was a presumption of privacy that was violated by the liberal nutjobs.

This is great ! This will spice up our local politics and evening news for while
I just read the news. I've met one of the individuals involved, and McConnells Louisville house is about 1/2 mile from mine.
I will be out in support of any of the non-McConnell people, for sure.
Regardless of legalities, McConnell showed his true colors--yellow and weasel gray--in the stuff they were going to focus on in regards to Judd. Im not quite sure why people who say the racial stuff about his wife was terrible arent holding he and his staff to the same standard with the items that were being discussed about Judd. Shameful. Typical nu-conservative.
One thing I do know as fact--one of the individuals who is supposedly involved in this is a tireless advocate for civil and neighborhood issues in Louisville. McConnell on the other hand, is only known for harming the working class with his obstructionism and the environment in his tireless pimping/getting rich from big coal lobby and getting it sent to china.
Kentucky is never predictable politically, but being here, it does feel like this is the coal trolls last hurrah.
Cant come soon enough

When are these people going to realize that THERE IS NO PRIVACY and they should speak as if they are in public at all times. If you are going to talk about a potential opponent in an insulting or scurrilous manner in private you had damn well better be willing to use the same words to their face in public. If you cannot do that you have no place in politics or anywhere else. If this was recorded from outside the room this guy was idiotic enough to yell his insults.
