Legally, they may be in the right, but boy is that cold-hearted.
Agree, they may be within their legal rights, but a temporary disability could certainly easily be accommodated. It's not like she was going to be bald for the rest of her life, nor would her scar be painful forever. Well, it happens, but it's pretty rare. If they'd let her wear a pretty cap, or put her in another position for the duration of the situation, it would have saved them time, money, and reputation.
Offer her a job in the kitchen in the mean time. That would be a reasonable accommodation.
Hooters is in the right. She wants $$$.
They are most likely in the legal right, but this is like evicting the orphans on Christmas eve.
Cut the gal a little slack about the $$$, she just had brain surgery and wanted to come back and continue working but they wouldn't let her. I think in this era about complaining about people just going on the dole, it's admirable.
She's probably got medical bills and is trying to stay alive too, the kitchen job at hooters probably pays less than 1/2 of her waitressing job.
So, what she is doing is "causing a scene" and it's her right to expose Hooters to the court of public opinion even though they will win in the legal courtroom.
Sounds like the manager of the restaurant she worked at was a really good guy and wanted to help her in any way he could. Then Hooters Corporate stepped in and demanded she wear a wig, even though it would affect her healing or her hair regrowth.
I hope they give her a billion dollars just because of sheer stupidity by Hooters Mgmt.
And you union haters wonder why the working people need some power from idiocy like this.
I wouldn't award her a dime.
Hooters is selling a product that requires attractive employees. They should have every right to require their servers to be attractive.
I don't go to Hooters because I don't buy into thier theory that men need a little fantasy to enjoy over-priced beer and wings. If you treat your workers like pieces of meat, I could care less what happens at your businesses.
With all the respect and empathy for persons with cancer and this young woman, but she knows the game. There are lots of waitressing jobs where servers are respected for thier work instead of the size of their rack. You lay down with dirty dogs, don't be suprised if you get the mange.
A LARGE SURGICAL SCAR is NOT attractive. Especially in place that serves food.

And especially in a place where attractive women are part of their product.
Forcing Hooters to employ this woman would be like forcing a strip club to hire a 300 pound woman.
