Have you noticed that it has become almost impossible for any level of government to implement almost any law now days?

Here are some examples:

If there is a highway planned, groups will sue and hold it up in court for years. When they lose, another group will sue using a new Judge and set of arguments to hold it up longer. They hope that the political will and desire will wane and eventually a new set of officals will change their mind.

Local, state or federal government will decide to fight illegal immigration with a set of new laws. People will sue and a friendly judge will step in and stop the law from taking effect. While the American Civil Liberty Union holds it up on appeal for years, the governments hands are tied.

It seems like it is impossible now days to pass any law without judical review. When did this start and what do you think about it?

I think there's far too many lawyers in the US and as a result they make 'busy work' for themselves.

It reminds me of a line from the movie "Red Heat" where Arnold is a Russian police officer and is talking to Belushi about crime in the US.

It went something along the lines of Belushi asking how come they don't have problems with a certain type of crime and Arnold says "We take them outside and shoot them" and Belushi says "Ohh, well the that would never work here, the lawyers would never go for it" and Arnold says "shoot them first". *chuckle*

It started when the government started to screw the citizens and when the government started writing laws that the citizens must obey, but the government doesnt have to.

It's not only the law suits, years ago, when a highly publicized criminal case was appealed it was because there were grounds for appeal such as procedural errors. These days it seems the only reason needed for appeal is you don't like the verdict. Once again the $$$ winners are the lawyers.

I think we have more activist judges now as well. Which encourages this sort of litigation.

Also another trick that's used is judge shopping. For example, say a highway is going to be constructed from one town to another in a certain area. People that oppose the highway will in a very organized fashion file separate lawsuits in different areas to halt the construction of the highway. Then after the plaintiffs see exactly which judges have been assigned the case they will drop all the other lawsuits except the one that's before the preferred judge. Which almost guarantees a victory in court.

If I remember correctly, this is also how Al Gore attempted to take Florida from Bush back when Bush was running the first time. The Gore campaign got a number of different people in different parts of Florida to file a lawsuit saying that they were disenfranchised in some way then dropped all the suits except the one that was before the democratic judge.
