The Court will determine that.
But the real issue is who does the 'kid' think he is tricking by having his girlfriend into taking a pill that kills the fetus. Does he really think he is going to have any type of future relationship with this girl. Does he think that he can have any relationship with anyone with this type of behavior and trickery.

Calm down, it's not that serious and charging him with homicide is simply judicial overreach. This won't have any impact on any future relationship of his any more than a woman choosing abortion affects relationships. Obviously if he is convicted then that will impact future relationships.

Legally, his obvious mistake was getting caught, but he said he didn't want to keep the kid and the girl decided that what he wants didn't matter. He decided that the girl should have an abortion and that what she wants didn't matter. It's the same thing from a moral standpoint. He probably has more moral standing; more than enough unwanted kids are brought into this world.

Do you know that under the federal fetal homicide law and some state fetal homicide laws, the fetus Is referred to as a child ---

'whoever engages in conduct that violates any of the provisions of law listed in subsection (b) and thereby causes the death of, or bodily injury to, a child, who is in utero at the time the conduct takes place, is guilty of a separate offense under this section.'

The woman in this case could have been in an abortion clinic ready to abort, taken ill, rushed to a hospital, and the man would still be Possibly guilty of murdering 'the child in utero.'

The bottom line is taking away her choice = prosecution for murder. Not assault against the woman, but murder of the child in utero.

I don't think a murder charge will stick. Maybe tampering with medication, but not murder.

He is being charged under the Unborn Child Protection Act.

People do seem to be missing this point. Cytotec is not one of the OTC abortion or Plan B pills, it is not recommended for that use in the US. It is an abortofacient, but is prescribed for other uses. Using this case as an argument against OTC pills is moot for this reason.

I guess you need to read up on the Unborn Child Protection Act because that is why and how he is being charged.
