Individuals can not file criminal charges.

The police and prosecutor decide whether to pursue a criminal prosecution, often based on your input and willingness and ability to participate in the process.

Or does your opinion here only extend as far as your fetish for revenge porn?
The object in question here belongs to the person you want to prosecute. It was gave to them.

It's more of a protection of our privacy.

I honestly don't know what the hell some of you are arguing. Maybe some of you have been the "revenge porn" ex and are just trying to cover your ass. If so, your sick.
The person who files charges is the distinct attorney. The person who thinks they have been wronged talks to the police who bring it to the da who files the charges at the court. The state (nanny state) creates the law for the police/da/court to enforce/interpret.

It is not for protection of privacy. Consent doesn't change after the fact. Either the person gave consent or the didnt, they don't get to change their mind later on. The picture/video is not their property, it is the property of the person who took the pictures/video. As long as the video/pic is taken in a legal way it is up to the owner to decide what to do with it.

Again, it is the state trying to make bad decisions illegal at the expense of free speech.

I think it was given to them.

Anyway, that it was given to them doesn't impede the government's legal authority to regulate how the photo is used.

A technicality.

You still have no argument.

I'm sorry. You won't be allowed to get revenge on your ex by posting nude pictures anymore. You'll just have to wallow in your bitterness rather than try to bring somebody else down.

It's none of the government's business to intervene in people's personal matters in this way.

Can you slander somebody legally? Black mail somebody legally?

Facts are not technicalities. The state is filing the charges.

It's so sad that people can't discuss something like this without getting all flustered and feel they must resort to personal attacks.

It's quite ironic really considering this topic. It's not O.K. for someone to give someone something that belongs to them because it might hurt someone else but it's all well and dandy for you to make completely unsubstantiated attacks.

It's not a personal matter if you post it on a public website.

Also, there are already many laws that regulate when, how, and where you can use your property, or display media. So in that capacity, this law is nothing new, and is entirely constitutional.

So it is very interesting that some people here are just now suddenly very opinionated about this issue - wonder why...

We already have laws that cover both of those.
