Guy has a friend. He see's his friends wife out with another man. They are slobbering all over each other in a bar with his hand up her skirt. The guy snaps a photo and posts it to Facebook. Do you think this might ruin this womans life? Should he get arrested for it?
Quite possibly, it depends on what standards of privacy a society wants to have.
I'm not going to reiterate in the same detail the same point over and over. the point remains that regulation of media is nothing new, and in this context there is no free speech issue, and there is no property right issue (and if there is, the government's interest is sufficiently compelling to prevail).
The government has no compelling interests, unless you believe the gov has the authority to ban all forms of media that can show someone in a negative light.
The point remains, a legally acquired photograph is the property of its owner, and the owner determines distribution as they see fit.

Anyway, the government does have an interest, considering how deleterious the effect of these published photos have had on the lives of the victims.

Despite you not having posted any. One state has gone this far and the articles note that other states that have considered it have decided against it.
This will lose in the courts also. If you want to keep it private and personal do not give it away.
