Oops, I goofed. Must be late in the day. I used 2/3 for ratification, when I should have used 3/4.

Levinson says there are 2 main reason the 2nd amendment has outlived it usefulness:

1.) It's anti-Federal.

2.) The Heller case turns over decision-making power to a group of people who have little expertise in it. He says hudges shouldn't make such decisions, legislators should.

Volokh says there is a basic human right to self-defense. Some may debate how far that goes, but pretty much everyon eagrees that if someone threatens you with death, injury, kidnapping, rape etc., you have the right to use force, including deadly force, to keep it from happening.

Derchowitz said there aren't anymore state militias, so the 2nd Amendment is outdated.

Douchewitz says he agrees with Volokh that we have the right to self defense. And therefore, he says, the 2nd amendment should have said the people have the right to self-defense, not the right to keep and bear arms.
