Lets see if we can make this "perfectly clear": Pres. Obama stated 3 years ago "If you like your plan you can keep it, if you like your doctor you can keep him, PERIOD" Not only did he state this once but he has been stating this over the last 3 years.
Now under the ACA or Obamacare, provisions were written into the law that requires insurance companies to offer a minimum set of coverage. This was the law as passed by congress.
Fast forward to today, insurance companies are dropping people who had coverage that didn't comply with the minimum standards, now refer to Obamas statement of 3 years ago. Now either Obama didn't know what his proposed laws entailed or he just out right lied to the American people.
Now to save face he is proposing an "Executive Order" to allow people to keep their insurance even if it doesn't comply with the ACA. Obama doesn't have the power to even suggest such a change, the only way this can be changed is repealing ACA through Congress!!!!!!!
This is the law Obama is trying to change illegally, Obama can not write laws into being, he doesn't have the power invested in the Constitution to do so. Only congress can write laws, the president signs them into action, the Supreme Court can rule if the law is valid Constitutionally.
Terry - the other option is to amend the law. It doesn't necessarily have to be repealed. The Senate democrats were proposing such an amendment. Regardless, it has to be passed by congress.
Don't go by government regulations and see if you are punished in some way.
Is this like penalty & tax, when it is argued before the SC?
A regulation can be enforced or not enforced at the discretion of the administrator. A law cannot.
