Appellate courts establish case law. Case law is legally binding on all lower courts, in essence making it law since those courts base their rulings on that case law. That's how a Common Law Legal System works.

The judge uses the constitution, and case precedence to law out the argument.
You didn't explain how the law is unconstitutional, you only cited the ruling, which is a circular argument.
