No. Gay couples have been getting married in churches and otherwise private ceremonies for decades in places where the state refused to recognize their marriage civilly.

Most states do not recognize common law marriages anymore. Only nine states recognize common law marriage, with 5 other states grandfathering in previous common law marriages.
Do gays believe that marriage must be a three-way inclusive of the government?
If so, why?
My sister got married in a state where its not legal. They're planning on making it official in a state where it is legal. They have a beautiful daughter now who's extremely smart and learning multiple languages.
Marriage is not a business. you get a business license for starting a business.

Marriage is essentially the same thing, at its core. The government has created a scheme governed by statute which confers automatic privileges and responsibilities towards another person. Tax benefits, immunities in court, etc. can all hinge on whether or not you have that marriage license. Just as in business, how you are treated in certain situations can be dependent on whether you are an LLC, Corp., or sole proprietor.
Honestly though, those that believe "government should get out of marriage" are usually all for government blessing LLCs, Corps., etc. for business.
The Pilgrims followed the Dutch form of marriage, which was a legal contract in the civil realm rather than a religious rite. This is because Puritans and other Protestants saw no biblical foundation for church control over marriage. Marriage was only established as a sacrament in the Catholic Church in the 12th century, and it took several centuries after that for the church to take it under its jurisdiction in more remote places (such as rural Scotland). Because marriage was a civil contract, questions of inheritance were handled by the state rather than the Church. (The Separatists recognized only two sacraments: baptism and the Lord's Supper.)

Government took over marriage in this country back in the 1800s.
Marriages were used since ancient times to answer legal questions about inheritance and legitimacy. That was kind of the entire point of marriage back then.

Of course after the fall of Rome their was no government so the church took things over, this changed when governments came back into existence in Europe,
Furthermore in the US the first requirment for marriage licenses dates back to colonial new England. Marriage has been a state affair in what would be the US since 1639.
