NASHVILLE, TN (AP) - The Tennessee Supreme Court has ruled that police may still have grounds to arrest people for DUI even if they pass field sobriety tests.

The ruling, announced on Friday, involved a Sevier County man whose DUI charges were thrown out after he passed six field sobriety tests.

The road was under construction (probably detours) and he passed SIX field sobriety tests and the judge still thinks he still could have been DUI.

Well just throw out the tests. We'll just take the cops' word for it that the driver is drunk.
That's basically what the judge is saying.

Not enough info here. This has always been the law in many places as wrote.

Its always been the case that if you pass all physical tests by then fail a breathalyzer you could still be charged.

The article doesn't state what was administered and what was failed.
