What needs to be ruled upon, is the practice by the EPA for writing laws, issuing penalties, handing out fines and punishments, taking away property, reassigning ownership of property, and denying people the use of their land.

The EPA, like all of these rogue administrative agencies, are the judicial branch, legislative branch, executive branch, and department of justice, all rolled into one. Each one is like an independent agency, driven purely by personal ideology or political agenda, with no need or concern about what the concerns, needs or desires of the people might be.

These agencies need to be run like the CBO, where all they do is offer suggestions and hand out reports to the legislative branch.

In 2007 SCOTUS ruled the EPA could regulate greenhouse gases under the Clean Air Act amendment of 1990. That law was never intended to be used for that purpose. Until the law is changed or we have a different court ruling that is not going to change. Even the climate legislation the Democrats passed in 2009 stripped the EPA of that power.
