Brother is an addict, doing what addicts do, sustaining his addiction.
What does this have to do with the Governor's ability to govern a state?
It sure does look like this situation has been covered in the local press, given there are pages and pages of media reports on google.
If the brother checks himself into treatment, he has a good shot at not doing prison time, dependent on the quantity of drugs he distributed and any prior convictions. This would be the most likely outcome regardless of his brother's position.
Mc Cain's wife, heir to the Hersey fortune, was addicted to pain pills and was caught forging prescriptions, crime. She eventually sought treatment. McCain has been a senator for almost three decades and ran for president in 2008.
Betty Ford had a 15 year addiction to pain pills and alcohol while her husband was in the Senate and White House.
Sooner or later, most families have or will face addiction, within their family.
His response to his brother's crime is also very telling. Also what his brother does reflects on the family values of the entire Tomblin family. This is a state where church and moral values are very important. Also how Earl is handling this is very corrupt. He has failed to denounce his brother the way Obama has failed to denounce his illegal criminal alien aunt who is on welfare. Unless the brother gets the maximum sentence possible I will be convinced that the governor pulled some strings on his behalf.
This is a common perception amongst those whose own families have yet to experience addiction or alcoholism or are in denial about a family member's situation.
Given the brother's age, race and if he seeks treatment, he will likely not serve prison time, unless the quality of pills is substantial or there are prior convictions. This would be the most likely outcome, regardless of his family connection or partisanship.
I think the brother should be given an especially tough sentence in order to send the people of the state and the country a message that nobody is above the law. If Governor Tomblin wants people to not question whether there was corruption involved and strings pulled he would give his brother the maximum sentence possible under the law. He was not only addicted, he was SELLING and DISTRIBUTING these drugs. It is hypocritical for the governor to claim he is tough on prescription drug abuse when his own brother is involved in such matters.
It is also an unspoken rule that when someone becomes a public figure, particularly an elected official, they and their family are in the public eye and are to be judged on an even higher standard than anyone else. Also Tomblin is NOT liberal given that WV currently does not have a constitutional ban on gay marriage and abortion is legal even after 20 weeks when a child can feel pain.
This alone should not be held against the governor. However, if it can be shown he tried to use his position to protect his brother or get a reduced sentence, that would be a scandal. I do agree that if the governor was Republican, the press would hammer him daily.

I think the judge and court should make a point to give the brother the maximum sentence possible with no clemency just so that they can be above reproach from the citizens so there is no question that true justice is served. As the brother of an elected official this person should be judged even more harshly and sentenced to more time in prison than a regular criminal.
Oh yes and do we really expect Obama to crack down on illegal immigration when his own illegal aunt, Zeituni Onyango, has not been deported yet?
