If he would have gotten a Nationwide permit from the Corps of Engineers BEFORE he started construction, he wouldn't have had to go through all of this. If the permit was denied, there would be an explanation and a plan could have been developed to fix the design. Then he could have resubmitted the application.
The State Engineer who told him his design was OK no doubt told him to get a permit, that is basic stuff. If the engineer didn't, then shame on him.
Obviously a bureaucratic bungle on the epas part in this case but i wouldnt want to eliminate the epa on the strength of this one incident, letting industry take care of its waste products and we'll be back to flammable rivers and air thats unbreathable.

That's the role of any governmental agency: sticking its nose into affairs of private citizens so the environment doesn't deteriorate for everybody else. We don't have individual environments on our individual properties, unfortunately we all have to breath the same air and drink the same water. Thank God our rivers no longer catch fire and there is no more smog over all big cities.

How did you arrive at that conclusion, the EPA is enforcing regulations already on the books if there is any fault it appears to reside with either the state or the property owner. You need to know what exactly the state approved to determine the issue.

Why yes, things were awesome before the EPA. The environment was really doing great. No CFCs ruining the ozone layer, no polluted water, car manufacturers were slashing emissions and putting in catalytic converters, the air was smog-free, and companies and people definitely weren't dumping sewage into the ocean and spreading cancer-causing pesticides everywhere.
Personally I like being able to stand on my balcony downtown and clearly see mountains 50 miles away, as opposed to needing to wear a face mask and being unable to see more than a few blocks away. If you prefer the latter, I hear Beijing is great this time of year.
The biggest criticism of the EPA is that they kind of suck at what they do. Anyone who's been to a place like southern WV can see the environmental devastation that comes from companies being allowed to dump and pollute without consequence for decades. It's not at all surprising that a company managed to contaminate the water for hundreds of thousands of people. They've been doing it for decades. The only difference is last time it actually made the news.
