Doesn't matter.

Article 1, Section 8, Clause 17...

Read it and tell me where this stands, Constitutionally?

In May, the Utah governor's lawyers filed 22 lawsuits against the United States seeking more than 10,000 "road" claims crossing designated wilderness, national parks and national monuments. Many of the more than 40,000 miles of so-called "roads" are actually wash bottoms, two tracks or rough trails.... trying to force the agency to open the area to off-road vehicles by claiming that the canyon bottom is a "highway."
The governor's land takeover will cost the taxpayer dearly. And the extensive privatization and development would destroy the great Western tradition of access for all to these extraordinary open spaces.

The great Utah land grab - The Standard-Examiner - Ogden Utah
These people are after nothing less than a self-serving land grab. It is a land grab by a Republican legislature determined to allow exploitation by those who have the political influence and money to buy up or otherwise control these lands when they become available. Almost on a daily basis, we hear local politicians, state legislators and other political figures complain about the tax revenues lost to the state because of federal ownership of the lands.
We should understand these complaints for what they are; a deceptive strategy to transfer ownership to the very interests that support and donate to the Republican Party.
Far from it. The federal government is a lousy, irresponsible manager of public lands. The Forest Service does little other than paperwork and closing facilities. Their timberlands are in terrible shape due to decades of mismanagement. Forests are overgrown, fire traps; selective logging to thin the woods are critical...yet nearly no timber harvesting is done. Recreation is the liveblood of rural communities, and the draw for public lands. Yet access is being closed constantly. ATV and motorcycle trails are being reduced every year, at a time of increasing demand. Access to dispersed camping areas is being closed. Access to historic hunting lands and hiking areas is being closed.

Add insult to injury, unlike every other property owner, the federal government pays no property taxes on the land they have seized. There is no constitutional right of the federal government to own land beyond what is required for buildings and military bases. It's way past time to return this land to the states.

Speaking about keeping the public out of their property, the BLM is banning geocaches on the public lands they manage:

BLM plans to remove geocaches from Badlands | News - Home

We can't actually encourage people to access their lands, now can we?

The land isn't there for people to enjoy. Someone might overturn a rock.

I recently wrote the Co parks and wildlife that I once again did not buy a Turkey tag cause the feds have a steel locked gate at the Forest entrance keeping us out. I road my bike up 5 miles on a dry gravel road to the next locked gate blocking access to a fed pay campground. What a joke these fed fools are. They think they and only they can use our National Forest.

It will be interesting to see what comes of this.

In my state of Pennsylvania, the state itself is a very poor manager of undeveloped lands. We have all the "Fracking" corporations exploiting both state-owned public and private lands, but they seem indifferent to the environment and they pay almost ZERO taxes. It was suggested that these corporations would create lots of jobs and transform the depressed regions of northeast, northcentral and central PA into a booming revitalized region. That never happened. The out of state money interests have benefitted and if you drive around the towns near where the fracking is done, they are as poor and depressed as they where 10, 15, 20 years ago.

Anyone notice how the Western law makers were mostly people who would be described as Tea Partiers? The other thing they dont want the National Parks they only want to skim the "cream" off the top and get hold of the BLM and National Forest. Once states get hold of that they will start selling off the lands to the highest bidders. The Indian Tribes in America are a lot smarter than the Tea Party types. They dont sell off their lands and they dont exploit it. If the Tea Party has its way they will sell off our national heritage to the highest bidder. It might even be the Chinese but most likely the Koch Brothers or an oil company.
