A woman visiting her mother in Oregon is suing her neighbor, seeking $275,000 for pain, suffering and other damages she says were inflicted when a pet duck ambushed her for no apparent reason.

Cynthia Ruddell, 62, of Washougal, Washington, was on her mother's property in Estacada, Oregon, about 25 miles southeast of Portland, when a neighbor's duck attacked her without provocation, according to the suit filed in Oregon state court last Friday.

She claims she had to sue because her medical treatments are ongoing and it was the only way to keep the owner liable for future costs.

If that's the case I'd side with the plaintiff.

And another thing (rant): says the owner had the duck killed after the incident. For the love of all that is holy when are people going to stop getting pets, be negligent in some way, and then the result is the pet has to be put down?

C'mon people. Get your blank together.

I thought this was the funniest comment (from the lawyer representing the plaintiff):

"I've learned a lesson," he said. "In any future lawsuit I'll talk about my client being attacked by a domestic animal. Not by a duck."

I wonder how long he's going to get ribbed about this one!

"Duck! Here comes that Lawyer!"

"Don't hire him, he's a quack!"

LOL

To be honest, she should have kept control of her pet so it didn't go wandering about. That's the duty of a responsible pet owner.

$275k is a lot, but people can really sue for anything...and the claim was just filed, not reviewed or gone through the courts. The clerk will accept any case that has the filing fee, is properly filled out, and is not covered in feces. So these news stories always seem to be a bit overblown to me.
