During Bush's attempt to seat Harriet Myers, I asked a very smart, very liberal attorney I know whether he'd rather see a smart conservative or a dumb liberal on the Supreme Court. Without even looking up from the brief he was writing, he said "a smart conservative".
He was right. Ginsburg should stay as long as she pleases.
Over in the elections forum, the libs keep assuring me that there is no doubt Democrats will keep the White House in 2016. This would seem to imply that there are doubts in the D camp about 2016, and frankly I'm surprised at that.
I feel like our Supreme Court is doing a pretty decent job given the cases that come before them, and the ridiculous hyper-partisan politics these days. I would much rather see a court that would be somewhat centered than one who will possibly vote based on party politics or a personal agenda. That's just my opinion.
She's only three years older than these two. Why did the OP exclude them from the conversation?
Because if Ginsburg steps down while Obama is in office there will be another liberal justice for the next 30-40 years. A conservative stepping down would enable Obama to act against the conservative justice's ideology by choosing a liberal justice. This ain't that difficult.
I don't like a lot of her opinions; I think she play politics with her job. That being said, she has no duty to retire while a democrat is in office. It is her job and her retirement, she should not base it on partisan politics. Perhaps she just has faith that a Republican will never win in 2016, and it's looking that way now.
