Just to spark controversy...

Why would that warrant the death penalty? HIV contraction is certainly not a guarantee. In this situation, the statistics are in the favor of transmission.. However, that isn't always the case, especially if such happens between a heterosexual couple.

He knew he was HIV positive and knowingly had unprotected sex with one of his students. Whether gay or straight, knowingly having unprotected sex with a partner who doesn't know you're HIV positive is the issue. You are risking infecting someone with an incurable disease that requires a life time of treatment and medication or risk a slow death is at best selfish, at worse attempted murder.
