Of course it will be abused. The definition of mental illness will be expanded (Do you take anti-depressants because you're having a hard time getting over the sadness of a divorce? Did you see a shrink after the death of a spouse?).

The definition will be expanded and so will LE's power to use their own judgement (as you indicated - fear of liability). And people will begin lying to their doctors about how they are feeling and not seek out help when they need it.

And this law will disproportionally affect women. Women have higher incidence of mental health issues than men do, women seek out mental health professional help more often then men, and are prescribed anti-depressants at higher rates than men.

It is also unconstitutional.

I've seen some real leaps in logic, or lack thereof but this one takes the cake.

As to the matter at hand, any such laws will be challenged, as well they should be, by the prohibition against a government taking found in the 5th Amendment which requires due process of law to deprive a person of property. Somehow I don't think a hearing up to 14 days after the fact meets that test and as mentioned in the article, abuse WILL occur.

Why are you worried about civil liability as a police officer, seems like the states have been very conservative with their definition of mental illness as it pertains to gun ownership. Some states have less than 100 people in the federal data base and you are worried about going to far.

Currently in America:

Mild depression due to low serotonine that can be rectified thru diet, exercise, and talk therapy is a mental illness.

And what's the worst result from taking away a few "too many" guns in some borderline cases? A little less chance of another Sandy Hook?

Simply unfathomable that anyone would worry more about a few gun seizures than about the next mass slaughter of innocent children that next time could be their own.

Yes I have, why are you as a police officer worried about civil liability rather than enforcing laws and taking guns out of the hands of the mentally ill. Like I stated taking the guns out of their hands has not been an issue at this point quite the opposite. If you are a police officer you should be worried about taking guns out of hands of the mentally ill or don't you believe that has been a problem.
