Yea, people this young don't realize the problems with this, but felony charges, and applied to just one of them, is over the top and unequal.
Felony charges for either is over the top.

I could support misdemeanor charges with a punishment of some kind of classes, community service, but their records are sealed at 18 or 21 so to future employers and even colleges, it never even happened.
I had to google "Manassas police penis" to find that.. Wonder what registry that just landed me on..
From that story..

He said the city was being portrayed unfairly, given the fact that the photos were never actually taken.
Yeah.. Right.. How many times do conspiracy laws get applied in this country every day? But, oh, YOU conspire to produce child porn and it's OK.. Asshat. And.. For the letter of the law part.. What the police wanted to do was produce child porn according to the letter of the law.
I don't even know why this is a case at all. There are so many things wrong with this case, it's not even funny.
First of all, the girl isn't facing charges, and as far as I can tell, she's the one who started the whole thing off.
Second, If I correctly read Virginia's statutory rape law, these two could have sex with no repercussions, but sexting each other is, somehow, a felony.
Third, as a result of this exchange, one of the kids (but oddly, not both) could be forced to register as a sexual "predator". Why not the girl? The way I understand it, she sent an erotic picture first.
Then there is the whole issue about police obtaining a warrant to photograph the kid's aroused junk. Who are these idiots?
Ya'll can laugh all ya want- meanwhile people's rights are being violated.
In reality- this is one of the most ludicrous, totally b.s. things I've seen so far.
Thing is- it's not going to get better...
Honestly it's like we're all guilty these days until proven innocent.
"Police already photographed the teen's genitals against his will when he was arrested in late January, she said."
Trey Sims, 17, was arrested and faces two felony charges for manufacturing and possessing child pornography for sexting with his 15 year old girlfriend. The district attorney, who already took unaroused nude photographs of Trey got a court order to also inject him with a chemical that would cause an erection so they could take more pictures.
Trey Sims' 2 year younger girlfriend who also sent nude pictures will not be charged.

A Virginia teen is facing two felony charges after he was caught sexting with his girlfriend.
If he's convicted, he could be forced to register as a sex offender and spend time in jail.
Trey Sims, 17, was charged with manufacturing and distributing child pornography in January, while exchanging texts with his then-girlfriend, who was 15 at the time. His iPhone and iPad were seized by police, and he was taken into custody.
Yet they never charge girls... It's always the boys who get charged.
