If he was put back on active duty then he's no longer a deserter is he ?
And if he's not a deserter then there is no controversy anymore.
And if there's no controversy then Obama is the knight in shining armor rescuing a "captured soldier".

To be tried in a military tribunal you must be under military authority.
As to the 'deserter' part in all of this .. It is clear that the guy went AWOL but as of yet, not clear if he can be declared a deserter.
AWOL is the act of leaving your post without permission with no clear indication of Not meaning to return.
Desertion is leaving your post with NO intention to return.
THAT is to be decided!
Under this administration .. I must assume that he will be awarded a medal for Good Conduct and promoted!
Why don't all you keyboard commandos and seasoned veterans of videogames contact the Pentagon, talk to the JCS and let 'em know that they screwed up and you have the answer for their next best move. Let them take advantage of your military expertise.

I was a commando long before we all had keyboards.
I speak from experience and have more than a few acquaintances who were tried for going AWOL.
Some had to reconfirm their pledge of allegiance and do community service under FORD whereas Carter granted amnesty for draft dodgers in 77.

My post wasn't directed at you or any other fellow veterans posting here. I'm addressing the foaming-at-the-mouth lynch mob "experts" who think they know everything about this situation already and are calling for Bergdahl's head.
If Bergdahl was derelict in duty, then he should be held to account. The reality is that all we currently have is scuttlebutt from a few who claim to have served with him. If the Army has more complete info, it'll come to light in due course.

Sometimes Americans go to Mexico and don't come back. If he was captured by a drug cartel and held for ransom, who would pay ? Would you ??
even if he did desert, he lived with the enemy five years, he know how they think. they not getting rid of him just yet
