Yes an arrest requires proof a law was broken. That level of proof can vary but they can not legally arrest you because they simply suspect you did something.

I wasn't implying he was choked to death.

But...

They're not allowed to use choke holds period. Whether it leads to choking to death or not, or to bring someone down.

Officer broke policy, and should be disciplined for breaking that policy. It shows a lack of training/ability to follow the rules.

Rest of what happened is something different.
