If Obamacare truly was written that only state exchanges could get subsidies and no mention of the national exchange - when it is clear that they are two different things - then the judges weren't being activists.

They merely did their job. They read the law and interpreted it as it was plainly written.

The Democrats wrote the law...and wrote it that way to pressure the Republican governors to create their own exchanges, since their citizens would be mad to miss out on subsidies otherwise. This political gimmick may have back fired.
