Last thing you want these days is to have a gun man, despite the age and knowing the average gang member is 15, to be in a situatuion where the gun wielding perp starts shooting up the kids on the playground.

Any negligence criminal or otherwise is what strengthens a civil suit.

Seems to me there was a breakdown in communication that it was a toy gun.

That would lead me to believe there is going to be a pay day on this one.

It doesn't strengthen it, it's absolutely necessary.

But classifying the death as a homicide says nothing about negligence.

Wow, now you are actually introducing reality into the situation. Some people can't handle that.

Exactly, when the state executes a death row inmate the manner of death is listed as homicide. Of the cases lately I think that Wilson most likely acted properly in the Brown shooting, that the fact Garner died of a heart attack, not asphyxiation, complicates the Garner case, but in this case I believe at least some sort of manslaughter charge is appropriate. The tactic the cops used was grossly negligent at the least.

Ohio is an open carry state. I think you can legally carry a gun on the playground.

Just saw the surveillance video, it almost looks like the kid was committing suicide by cop.

I would have shot the little moron myself.

Come on now. I find that very hard to believe. I'd classify that act as cowardly.


The boy was shot within 2 seconds after the officer left his vehicle.




Thanks posters for the clarification on the other part. Saw this on lunch break and wanted to pass on the info.

Negligence is not the only cause of action to bring a civil suit.

Homicide != Murder

Justified killings are included with homicides.
