Keeping people imprisoned with no charges is lunacy.
That is exactly what the court offered and asked him to do. The criminal refused to do so. He is being detained by his own choice.

i do not think the court charged him for refusing to testify.

They didn't, because he hasn't refused to testify at trial yet. He didn't testify early. They said do it and you get out. Don't and you stay in. He didn't and stayed in.
