I've seen a few stories about passengers with severe peanut allergies that necessitate the cabins scrubbed and peanuts banned from the flight. Total silliness. What if there's a peanut in between the seats or somebody opens a bag of pretzels that was exposed to peanuts? I just wouldn't put my kid in that situation.

Yes, the parents are responsible for making sure the boy has his medication available, not outdated, and with him at all times, especially when eating out. Very sad but cannot hold minimum wage employees responsible for knowing what is in a pre-mix pancake batter. Most ingredients listed on packages are given in the chemical name.

Look up the ADA and reasonable accomodation. It's very controversial.

Sounds to me like a personal injury lawyer convinced the family, "someone has to pay".
The restaurant isn't to blame. I agree.

Seem like the only fatal error was forgetting the epipen and other meds to deal with reactions.

Right because if my son has severe dairy allergies Im going to let him eat frigging pancakes at a restaurant.

Here is some advice- you have a food allergy severe enough to cause you to die, Dont eat out without your that can save your life.

In a busy restaurant, it's easy for such a simple mistake to be made. If you have this level of allergy to such a common food product, you DO NOT EAT AT A RESTAURANT WITHOUT YOUR MEDICATIO!! Questions that should be asked include what part of the milk is the source of the allergic reaction? Is the source also found in powdered form? Was the source of his reaction a mistake from the kitchen or from the plant that produced the product used in the kitchen? While the product used may not list milk in it's ingredients, that doesn't mean milk products didn't get into the product or wasn't properly labeled as having milk. Was the kitchen boiling milk for a dish? Is boiling milk enough to put milk proteins in the air to cause an allergic reaction?
