CNN had this video about a pregnant woman getting arrested for not giving her name. I don't understand why people have to give police so much trouble? Why not give a name and move on she seems to be the more aggressive one between the 2 woman. Just because the ACLU says she didn't have to giver her name. I think they the ACLU want to just make publicity off it the police were not racist. If the white woman had done the same she would be arrested.
I feel bad for the Cops who have to take time out of their busy day to respond to this type of petty arguments.
Why didn't she just say her name? Why did she give him attitude? It looked like she tried to walk away. Cops don't like when you ignore them, it is like saying "Do you know who I am".
Why wouldn't she give her name is she trying to hide something? That is where the cops mind goes.
What does the law say? It appears that one does not necessarily have to identify themselves. Honestly, this was a waste of time. The white chic looked like a ghetto rat (bleach blonde hair and trashy outfit) just looking for a problem. She seemed more aggressive to me. Couldn't really even understand her. The black woman should have given her name to police but likely felt she was being harrassed.
When you are just walking down the street or otherwise doing nothing illegal, the police do not have the right to stop you. They have every right to ask your name (1st amendment, free speech), but you are under no obligation to provide it (4th and 5th amendments).
If there is a disturbance of the peace (fight, argument, etc.) the police DO HAVE the right and legal obligation to investigate the disturbance. This includes the right to establish the identities of the people involved, and even the right to hold participants for questioning.
